SJPD Investigating Traffic Fatality #1

On January 27, 2023, at approximately 4:20 AM, Officers responded to the area of Cottle Road and Blossom Hill Road to investigate a solo vehicle traffic collision. The preliminary investigation revealed the following:

A 2018 Hyundai Sedan, reported stolen to the Santa Clara County Sheriff’s Department on January 26, 2023, occupied by a juvenile male driver and two passengers, was traveling northbound on Cottle Road at a high rate of speed when it left the roadway and collided with a light pole on the southeast corner of the on-ramp to Blossom Hill Road. The collision caused the vehicle to immediately burst into flames.

First responders arrived to the scene and provided emergency medical aid. The male driver suffered non-life threatening injuries. A female passenger was transported to a local hospital where she succumbed to her injuries and was pronounced deceased. An additional male passenger was declared deceased at the scene.

SJPD and ABC Conduct Minor Decoy Operation

 On January 9, 2023, San José Police Department Officers, along with agents from the California Department of Alcoholic Beverage Control (ABC), conducted a Minor Decoy operation in which minors under the direct supervision of department agents attempted to purchase alcohol from six retail licensees in San José. None of the locations sold to a minor decoy.

ABC conducts these compliance checks statewide to reduce the availability of alcohol to minors. Statistics have shown that young people under the age of 21 have a higher rate of drunk driving fatalities than the general adult population. According to the National Highway Traffic Safety Administration (NHTSA), about 25 percent of alcohol-related crashes involve underage drinking.

Minor Decoy operations have been conducted by local law enforcement agencies throughout California since the 1980s. When the program first began, the violation rate of retail establishments selling to minors was as high as 40 to 50 percent. When conducted on a routine basis, the rate has dropped to below 10 percent in some cities. In 1994, the California Supreme Court ruled unanimously that use of minor decoys is a valid tool of law enforcement to ensure that licensees are complying with the law.

Funding for this program was provided by a grant from the California Office of Traffic Safety through NHTSA.

SJPD Investigating Homicide #2

On January 1st, 2023, at approximately 2:48 AM, Officers responded to the area of 60 North Jackson Avenue on a report of an assault incident. When they arrived, they found an adult male suffering from injuries he sustained from being struck by a vehicle. The victim was transported to a local hospital where he was admitted with serious but non-life-threatening injuries. On January 15, 2023, the victim succumbed to his injury at the hospital and was pronounced deceased.

The suspect responsible for this incident was contacted and arrested for assault with a deadly weapon on the day and time of the incident. He will be identified in the coming days. Homicide charges will be presented to the District Attorney’s Office. The motive and circumstances surrounding the incident are under investigation.

The identity of the deceased victim will be released by the Santa Clara County Coroner’s Office after confirming the victim’s identity and notifying next of kin.

This is the City’s 2nd homicide of 2023.

On January 1st, 2023, at approximately 6:10 PM, Officers responded to the 400 block of West San Carlos Street on a report of a person shot. When they arrived, they found an adult male suffering from at least one gunshot wound. The victim was transported to a local hospital where he was admitted with a life-threatening injury. On January 9, 2023, the victim succumbed to his injury at the hospital and was pronounced deceased.
