UPLAND >> A probationer punched and tried to gouge the eyes of an Upland police officer who had pulled him over Saturday night, causing injuries that sent the officer to the hospital, authorities say.
Two officers pulled over 22-year-old Cody Tyler Duke in the 1500 block of North Benson Avenue just before 6 p.m. for a “DUI traffic collision investigation,” according to an Upland Police Department news release.
When the officers tried to place Duke under arrest, he punched one in the face several times, the news release said, before trying to “gouge the officer’s eye out with his fingers.”
He kicked the other officer in the stomach, the new release said.
The officers eventually managed to subdue the suspect and take him to jail. The first officer’s eye “began to swell and closed” while being taken to a hospital.
Duke was booked into jail on suspicion of resisting an officer, attempted mayhem and driving under the influence of alcohol and drugs. Bail was set at $100,000, jail records show.
San Bernardino County court records show Duke was sentenced to three years’ probation in 2015 for a misdemeanor count of reckless driving. As part of his plea deal, a charge of driving under the influence of drugs was dropped, and his probation terms included not driving with any drugs or alcohol in his system.
